Terms & Conditions of Service

 

GENERAL

1.0      A 20% booking deposit is required to secure a booking of musicians through Melanie Wason Music for the agreed date. Deposit payment indicates client acceptance of the quoted services and acceptance of the terms of service outlined here.

A booking is not confirmed until a deposit has been received.

Payment structure for our services are as follows:

  • 20% deposit at time of booking

  • Balance 14 days prior to wedding/event

Any quotes or inclusions are valid for 30 days.

 

1.1      If the timings and details specified by a client at a later date contradict our previous communications, inclusions and/or original quotes, Melanie Wason Music may be required to charge additional costs, as per the new requirements – e.g. At the last minute a client decides to extend the reception from 5 hours to 6 hours.

1.2      For bookings of 4 hours and beyond, it is a requirement that clients provide musicians with a basic crew meal.  This is industry standard, and the venue or catering company will be able to organise this with you. Clients can assume that there are no dietary requirements unless otherwise stated.

 

1.3      Private Property Weddings:  There are some key issues related to our working conditions on private properties which need to be considered
1.3.1    If the client does not have a venue manager then someone must be appointed as a contact for us to liaise with us on the night, regarding any issues that may arise.
1.3.2   Phone reception: If there will be no phone reception then this must be mentioned beforehand
1.3.3   If the private property is difficult to find, very detailed instructions about how to locate the venue, and a number to call in case we are still experiencing difficulties if required.

 

1.4      Flight prices: If flights are required for a job, we will quote prices that are valid at the time of the enquiry.  As a result, if it takes weeks/months for the booking to be confirmed by way of making deposit, then the flight prices originally quoted may be subject to change.

BAND CONDITIONS

2.0     Our prices are based on a start/finish time of 3 hours or 5 hours as specified in the quotation. The definition of “start time” is defined as the time the band is required to have finished bump-in and sound check at the venue and are ready to play.  “Finish time” refers to the time the band can finish playing and commence packing up equipment.

 

2.1     Melanie Wason Music Band will supply appropriate background music during band breaks which is connected to the PA system provided. This is included in the price. Clients are welcome to supply their own iPod/Spotify list to be played through the band’s PA system if preferred.

 

2.2     The band will arrive approx. 45-70 minutes before the due start time, with the full PA system & drum kit as required. If a client or venue require the band to set up earlier than this, then an additional charge may be involved.  If additional time is asked of the band in regards to set up/sound check, then this will be billed at a rate of $75 per musician per hour, or $37.50 per musician per half hour.

 

2.3     For any bookings that exceed 12am, an additional fee will be incurred at a rate of $50 per musician, per each additional 30mins.

 

2.4     Additional hours (i.e. for receptions longer than 5 hours): These are billed at a rate of $75 inc gst per musician per half hour, or $150 inc gst per musician per hour.

 

2.5     On occasion it may be necessary to use alternative musicians (fill-in's). This is a backup if any musician takes unwell, is injured, or for any other reason unable to be there. We have this as a security for the Client. This allows us to guarantee that The Band will not pull out due to the above reasons. There will be no reduction to the fee. A fill-in does not constitute grounds for cancellation.

 

2.6     Band Requirements for Private Property/Outdoor Weddings.  The band’s set up location must include the following:

  • A dry area which is under cover. We are happy to perform outdoors without cover for ceremony and canapés performances if weather permits, but for the reception we require a roof over our heads at the very least.  Wet equipment is a serious hazard for our musicians and guests.

  • If the area has open walls where the band is set up then heaters must be on hand.

  • A flat, dry and hard surface to set up on.
     

2.8     Power requirements

  • One separate circuit of 10A @240v. (i.e not sharing the circuits with lights, fridges, bain maries etc.)

 

2.9     Our PA Sound System 

For weddings/events that are 0 – 200 guests we have adequate front of house speakers, mix desk, microphone etc, included as part of our quoted price.

 

3.0     Sound Restrictions

It is vital that clients read their venue contract to establish whether there are any decibel level (sound level) restrictions.  Some venues keep these restrictions discreetly buried in their fine print as if to suggest it is a minor issue, but this is not always the case.  We are naturally happy to work at any venue, and co-operate with all venue owners/managers, but some venues have such intense restrictions that they can prevent us from delivering our product satisfactorily.  Sometimes, these restrictions have not been made known to us by the client (or venue) until we commence the dance sets on the night.  This dynamic can prevent us from performing with the energy and entertainment that we are renowned for.  We will always do our best to work with a challenging situation, but we do urge all clients to read the venue contract carefully and if there are restrictions, please ascertain the specific decibel level and inform us in advance, so we know what we will be working with.

 

CANCELLATIONS/POSTPONEMENTS

4.0  Contract Change and/or Cancellation Policy:

In the event of a cancellation by the client, the following fee will be charged:

  • 180+ days before the wedding date: 0% of the remaining fee.

  • 90 to 180 days before the wedding date: 25% of the remaining fee.

  • 60 to 90 days before the wedding date: 50% of the remaining fee.

  • 30 to 60 days before the wedding date: 75% of the remaining fee.

  • Within 30 days of the wedding date: 100% of the remaining fee.

 

4.1 a) If a request for a date change is made after 30 days of the deposit being paid  (but more than 180 days before the event), this is deemed a cancellation – as our business and our creatives/artists will have committed to that specific wedding/event date.  A new deposit will need to be paid if a client wishes to book us again for a new date.

If an instalment or balance payment has been made then this will always be refunded in full.  It is only the deposit that is non-refundable.

4.2     If a client wishes to change the confirmed band configuration (eg. downsize the band or swap for an alternative instrument) and, subsequently, a booked member of staff is no longer required, this is deemed a cancellation of that member(s) and a fee of $150 must be paid per cancelled employee.  A client may increase the band booking, in which case our standard fees would apply.

4.3     If an instalment or balance is to be refunded for any reason, the refund will be minus any credit card or Bpay processing charges incurred at Melanie Wason Music’s end.

PRIVACY POLICY

Melanie Wason Music (MWM) is committed to providing quality services to you and this policy outlines our ongoing obligations to you in respect of how we manage your Personal Information.

We have adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (the Privacy Act). The NPPs govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information.

What is Personal Information and why do we collect it?

Personal Information is information or an opinion that identifies an individual. Examples of Personal Information we collect include: names, addresses, email addresses, phone and facsimile numbers.

This Personal Information is obtained in many ways including interviews, correspondence, by telephone or email, our social media platforms (Instagram & Facebook), via our website www.melaniewason.com.au, from your website, from media and publications, from other publicly available sources, from cookies and from third parties. We don’t guarantee website links or policy of authorised third parties.

We collect your Personal Information for the primary purpose of providing our services to you, providing information to our clients and marketing. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. You may unsubscribe from our mailing/marketing lists at any time by contacting us in writing.

When we collect Personal Information we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.

Sensitive Information

Sensitive information is defined in the Privacy Act to include information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.

Sensitive information will be used by us only:

•           For the primary purpose for which it was obtained

•           For a secondary purpose that is directly related to the primary purpose

•           With your consent; or where required or authorised by law.

 

Third Parties

Where reasonable and practicable to do so, we will collect your Personal Information only from you. However, in some circumstances we may be provided with information by third parties. In such a case we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party.

 

Disclosure of Personal Information

Your Personal Information may be disclosed in a number of circumstances including the following:

•           Third parties where you consent to the use or disclosure; and

•           Where required or authorised by law.

 

Security of Personal Information

Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorized access, modification or disclosure.

When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information. However, most of the Personal Information is or will be stored in client files which will be kept by us for a minimum of 7 years.

 

Access to your Personal Information

You may access the Personal Information we hold about you and to update and/or correct it, subject to certain exceptions. If you wish to access your Personal Information, please contact us in writing.

Melanie Wason Music (MWM) will not charge any fee for your access request, but may charge an administrative fee for providing a copy of your Personal Information.

In order to protect your Personal Information we may require identification from you before releasing the requested information.

Maintaining the Quality of your Personal Information

It is an important to us that your Personal Information is up to date. We  will  take reasonable steps to make sure that your Personal Information is accurate, complete and up-to-date. If you find that the information we have is not up to date or is inaccurate, please advise us as soon as practicable so we can update our records and ensure we can continue to provide quality services to you.
